You are getting threatened on the phone by a debt collector such as a collection agency; ( threats that may violate the law include but are not limited to: immediate garnishment of wages without a Court hearing, threats to take social security or pension income, threats of charges being filed against you or imprisonment for not paying a debt, etc.)
A debt collector is calling you names or using abusive language that may include profanity;
Debt collectors such as a collection agency or law office are calling your neighbors or relatives including parents;
Your are receiving calls before 8 A.M. or after 9 P.M. where you are located;
You are receiving calls to your cell phone when you did not give consent for your cell phone to be called;
Collectors request payment on an account that was previously paid off;
A collector sues you on an old debt which is beyond the Statute of Limitations; ( Depending on the type of debt, there are varying time periods in which a debt collector may take legal action against you in a Court of Law.)
A Debt Collector sues you in a county where you do not reside or where you did not execute a contract or make a purchase;
You are sent an initial 30 day letter from a debt collector which you sent a written dispute and the debt collector continues to call or write you without having sent you verification of the debt;
A debt collector reports or threatens to report false information to a credit bureau; ** These are just a handful of examples of possible scenarios where you may have a claim under the Fair Debt Collection Practices Act or Telephone Communications Protection Act. ** Statues of Limitations for seeking recovery by filling a lawsuit against a debt collector may be limited to 1 year from the date of the debt collectors offensive conduct. If you wish to take action, time is of the essence, and it is always best to seek guidance from an attorney experienced in handling consumer law issues.
